On 9th Sept, 2018 the government of Tamil Nadu, recommended to the Governor the release of all 7 convicts of the case. The Governor has kept his decision pending despite receiving the recommendation of the Council of Ministers. The SC noted that such a long pendency of a Mercy Plea is not acceptable.
Sc held that a convict was free to approach the Governor or the President for seeking Pardon. The power of pardon of Governor or the President “untouchable and unapproachable and cannot suffer the vicissitudes of simple legislative processes.”
