Starbucks awarded Rs. 13 lakh by Delhi HC in a lawsuit against Jaipur-based Cafe
Starbucks stated that in 2018, they found a Jaipur-based LOL Cafe selling Brownie Chips Frappuccino, without license.
A cease-and-desist notice was sent to the Cafe in December 2018 and a reminder on January 2019, both of which went un answered.
It was assured by the Director of the Cafe that they would cease the use of word, Frappuccino and will update their menu cards on their-party apps such as Zomato and Eazydiner.
It was found that the Cafe continued to sell it products and using the trademark, Frappuccino, illegally, even after Director's undertaking.
Another reminder was sent to the Cafe on May 2019, which was again ignored.
After repeated notices, High Court passed an ex parte ad interim injunction against the LOL Cafe on August 23, 2019.
High Court permanently restrained the Cafe from selling its Frappuccino on November 17.
Starbucks was awarded Rs.13, 38,917.85, termed as legal fee by the Delhi High Court.
